Vladeck: A lot of folks saw that unidentified federal law enforcement personnel had set up a checkpoint… Those kinds of checkpoints are not generally legal. The Supreme Court has upheld checkpoints for specific purposes — like sobriety checkpoints… But just stopping everyone at random “because we can” is not something the Supreme Court — even this Supreme Court — has ever sanctioned. There’s one video showing a DEA officer telling a D.C. resident he couldn’t drink alcohol on his porch—D.C. law says exactly the opposite. It also highlights how these officers aren’t even trained in the laws they’re purportedly enforcing.
